This Prenuptial Agreement ("Agreement") is entered into on __________ (the "Effective Date"), by and between __________ ("Party One") and __________ ("Party Two"), collectively referred to as the "Parties," with reference to the following facts:

Recitals

A. The Parties are contemplating legal marriage under the laws of the Commonwealth of Kentucky, and

B. The Parties wish to establish their rights and responsibilities regarding each Party's current and future property, both separate and marital, and

C. This Agreement is intended to preclude the application of the marital property laws of Kentucky, except as specifically provided herein or as otherwise required by Kentucky law.

Now, therefore, in consideration of the mutual covenants and agreements contained herein, and for other good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, the Parties agree as follows:

  1. Identification of Property. Each Party to this Agreement has disclosed to the other a complete financial statement listing all assets and liabilities owned or owed by each Party as of the date of this Agreement and identified as Exhibit A (Party One) and Exhibit B (Party Two), which are attached to and made a part of this Agreement.
  2. Separate Property. The Parties acknowledge that each Party's separate property includes all assets and liabilities listed in Exhibit A (Party One) and Exhibit B (Party Two) and any property acquired or inherited by either Party individually during the marriage.
  3. Marital Property. All property acquired by the Parties during the marriage through their joint efforts shall be considered marital property and shall be divided according to the terms set forth in this Agreement.
  4. Amendment. This Agreement may only be amended by a written document signed by both Parties.
  5. Enforcement. In the event of separation, divorce, or annulment, this Agreement shall be presented to the court and subject to enforcement under the laws of the Commonwealth of Kentucky.
  6. Governing Law. This Agreement shall be governed by, interpreted, and construed in accordance with the laws of the Commonwealth of Kentucky, without giving effect to any choice or conflict of law provision or rule.
  7. Complete Agreement. This Agreement contains the entire understanding between the Parties and supersedes all prior discussions, agreements, or understandings of any kind.
